Shambali Retreat Participants Disclaimer

In this disclaimer, "we" means (and "us" and "our" refer to) [SHAMBALI RETREAT]  as shambali, which has its principal place of business at bali indonesia.

  1. BOOKING

(a) Your booking is not considered definite and no contract will exist until we receive a 100% payment from you and you agree to these terms and conditions.

(b) We do not share customer details with any 3rd parties.

(c) Space is subject to availability and places are filled on a first-come basis upon receipt of the full payment. Retreat program and retreat center arrangements may change due to unforeseen circumstances.

  1. PAYMENT

(a) The price is the exact amount to be received by us in US Dollars. Depending on the payment method, any bank and extra transfer, credit card charges to be paid by the participant in addition to the price of the retreat.

(c) We do use a secure online platform for the payment. We do not take any responsibility if there is any loss or extra charges occur by your bank.

  1. YOUR TRAVEL ARRANGEMENTS

(a) All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost.

(b) PASSPORT, VISA, AND RELATED ITEMS.  You are responsible for obtaining and maintaining a valid passport and all appropriate visas, permits, certificates, and/or other required documentation (“Documentation”) for the countries, jurisdictions, parks, areas, etc. you will visit during the Retreat. We are not responsible if you are denied entry or exit to/from any country or location due to a lack of valid Documentation.

(c) TRAVEL INSURANCE. We strongly recommend the purchase of travel insurance for the Retreat. You are solely responsible for the cost of any travel insurance and ensuring that you are adequately insured for the full duration of the Retreat with respect to possible illness, injury, death, property damage, loss of baggage and personal items, cancellation and/or curtailment, and/or any other potential losses, damages, costs, expenses, or liabilities (collectively “Losses”). You will be solely responsible for any Losses related to your failure to procure travel insurance.  We are not responsible for any Losses you incur and/or sustain.

  1. HEALTH AND FITNESS ELIGIBILITY

(a) YOUR HEALTH. You represent that you are over the age of eighteen (18) and are healthy, in good physical and mental health, and are at a level appropriate to participate in, and are fully capable of participating in, the Retreat. You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in the Retreat, including any Physical Activities. You have consulted with your physician and your physician has authorized you to participate in the Retreat, including any Physical Activities. You will discuss and address any questions or concerns you may have about your physical or mental health with the appropriate health care professional prior to the Departure Date. Documentation from your physician confirming your clearance to participate in the Retreat can be provided upon request.  If, at any time, you have any doubts about your physical condition or fitness to participate in any aspect of the Retreat, you will cease participation in the same and seek appropriate medical attention. YOU ARE HEREBY ADVISED THAT THE RETREAT MAY TAKE PLACE IN REMOTE AREAS WHERE THERE IS LITTLE OR NO ACCESS TO TRADITIONAL MEDICAL SERVICES OR HOSPITAL FACILITIES FOR SERIOUS HEALTH ISSUES (OR YOUR PARTICULAR HEALTH ISSUES). YOU ARE FURTHER ADVISED THAT ANY MEDICAL OR EVACUATION EXPENSES WILL BE YOUR SOLE RESPONSIBILITY. As a result, we strongly encourage you to purchase travel insurance with appropriate coverage for your needs. We reserve the right in our sole discretion to refuse your participation in the Retreat, any Retreat Classes, Physical Activities, and/or any other activities, due to medical, fitness, or other grounds. The company also reserves the right to deny participation in the Retreat or any related activities at any time to individuals demonstrating behavior that may result in injury to themselves or others.

(b) PREGNANCY. Women who are 12 to 28 weeks pregnant should provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide. Some of the activities may not be suitable for pregnant women at any period of their pregnancy.

  1. ASSUMPTION OF RISK

You understand that serious accidents may occur during Physical Activities, including all in the resort and out of resort Retreat Activities, and that participants can sustain fatal and/or serious personal injury.  As stated above, the Retreat may take place in a remote location where there is little or no access to traditional medical services or hospital facilities for serious and/or particular health issues. You may also be visiting places where the political, cultural, and geographical attributes of the location present risks and physical challenges that are greater than those present in your country of residence. It is your own responsibility to familiarize yourself with all possible relevant travel information in connection with your participation in the Retreat. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel and engaging in Physical Activity (including all the activities in and outside of the Resort) which may include injury, death, property damage, and/or any other kind of Liability, whether foreseen or unforeseen, which may occur during your participation in the Retreat. YOU ACKNOWLEDGE THAT YOUR DECISION TO PARTICIPATE IN THE RETREAT IS MADE IN FULL CONSIDERATION OF THE FOREGOING INFORMATION AND THAT YOU SOLELY AND EXCLUSIVELY ASSUME THE RISKS INVOLVED WITH PARTICIPATING IN THE RETREAT. IN NO EVENT WILL COMPANY BE LIABLE FOR ANY LIABILITIES ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THE RETREAT.

  1. INJURY

In the event you are injured while participating in the Retreat, you agree to assume all financial obligations for any and all medical costs you incur.  You acknowledge and agree that IN NO EVENT SHALL COMPANY AND/OR ANY COMPANY PARTY BE LIABLE OR RESPONSIBLE FOR ANY LOSSES OR LIABILITIES ARISING OUT OF YOUR PARTICIPATION IN THE RETREAT.

DISCLOSURE: I am aware that during my participation in the Shambali retreat certain risks and dangers may arise, including, but not limited to, the hazards of traveling to the retreat location, forces of nature, an accident or the onset of illness. Also, I am aware and clearly understand that retreat organizer or resort will not have liability regarding provision of medical care, the speed of evacuation or the adequacy of any care that may be rendered.

  1. RESORT RULES

(a) SAFETY

(a) SMOKING: Smoking is strictly prohibited inside the retreat cottage premises. Failure to comply with this provision will result in facility owner or manager has the option to immediately terminate occupancy, increase site rental fees, and assess a service charge plus the costs of cleaning and repairs.

  1. RETREAT RULES

(a) Shambali Company hosts retreat with mature adults. If, for any reason, the Retreat Leaders feel that any participant(s) is causing a disruption or behaving in an anuntoward manner, Shambali Company and Resort reserve the right to remove any such person(s), at his/her own expense.

(b) COMPLAINTS. If you have a problem during your retreat, please inform the organizer immediately and he/she will endeavor to put things right. Please note that we cannot be responsible for the individual behavior of any group member or other guest sharing your accommodation.

  1. AMENDMENTS BY US

Retreat program and retreat center arrangements may change due to unforeseen circumstances. Occasionally, changes may have to be made (e.g., instructors, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

  1. CANCELLATION, REFUND, and RESCHEDULING

  • CANCELLATION

By you:

We do not accept cancellations for unforeseen changes in your personal circumstances or for any other reasons that are not mentioned in our disclaimer. Therefore we do not refund the payment for any cancellation due to the changes in your personal circumstances. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your insurance.

By us:

  • In normal circumstances, we will not cancel the retreat for any reason. However, we hold the right to cancel the retreats for any reason caused by other events beyond our control. In case of any unforeseen event occur, we will credit your payment that you can use within 12 months, or you will have the right to demand a refund of your payment.
  • We reserve the right in any circumstances to cancel a retreat. In particular, our retreats require a minimum number of at least 75% of the participants to have booked by 30 days before the start date. If this minimum number is not reached by that date we may cancel the retreat and refund the money to you.

Third party:

We do not accept any liability for cancellations, delays or changes caused by war, a threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, or other events beyond our control. In case of any third party reasons mentioned above, we will credit your payment that you can use within 12 months for another retreat, or you will have the right to demand a refund of your payment.

  • REFUND

Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat.

If any cancellation occurs by the third party effects mentioned above, you will have right to reschedule your retreat or if you want to cancel your retreat we will refund your payment. We can also credit your payment that you can use within 12 months for another retreat.

We do not offer a refund for any other reason that is not mentioned in our disclaimer.

The refunding process may vary according to your payment method, bank, and country of the bank. In the case of refunding, we will not be liable to refund you the bank charges or any other transaction fees that had occurred when you initially settled your payment to us.

  • RESCHEDULING

You have right to reschedule your retreat latest 90 days before your retreat start date. Any other request on rescheduling (unless by a reason that is mentioned in our disclaimer) will not be acceptable.

  1. VOLUNTARY PARTICIPATION IN STRENUOUS ACTIVITY

You acknowledge that you are voluntarily participating in the Retreat with Company, which may include strenuous physical activity including without limitation walking, running, hiking, dancing, climbing, swimming, jumping, yoga, plyometrics, Retreat Classes, and various other exercises or physical activity (“Physical Activity”). You acknowledge that you are fully aware of the risks and hazards connected with participation in the Retreat and/or engaging in Physical Activity, which may include the risk of serious injury (e.g., heart attacks, muscle strains, pulls, tears, broken bones, shin splints, and other illnesses) or death, and you hereby elect to voluntarily participate in such Physical Activities as part of the Retreat.
